This is the last will and testament of me Aholiab Bradshaw of Priors Marston in the County of Warwick Esquire First I give and bequeath all and every my monies and securities for money and all other my personal estate of every part and kind unto my friend Samuel Vanderplank of Long Bucky in the County of Northampton Gentleman and Richard Marriott Freeman of xxxxx Buildings Holborn London Gentleman their executors and axxxxxs upon Trust xxxxxxxx and to and for the several uses and interest and purposes hereinafter mentioned that is to say you(?) Trust within six calendar months next after my decease to pay and apply the sum of two thousand pounds part of the paid trust monies(?) unto my Sister Frances the wife of Alexander Duke of Fissington in the County of Warwick Esq and to the executors axxxxs and assigns and upon trust within 6 calendar months as aforesaid to pay and apply the further sum of five hundred pounds xxxx part of my said Trust monies unto my Cousin Ann King of the City of Coventry widow and to her executors axxxxs and assigns and upon trust within six calendar months as aforesaid to pay and apply the further sum of five hundred pounds xxxxx part of my said Trust monies unto my Cousin Jane Freeman of the City of Coventry spinster and to the executors axxxxs and assigns and upon Trust within six calendar months as aforesaid to pay and apply the further sum of five hundred pounds xxxxx part of my said Trust monies unto my Cousin Jane King of the Borough of Leicester widow and to her executors axxxxs and assigns and upon Trust in the next place(?) within six calendar months as aforesaid to put and xxxx out sum of five hundred pounds her(?) part of my said Trust monies out at interest in their own names upon Government of good real security and pay and apply the half yearly interest dividends and profits there from time to time as they shall xxxxxx fit and payable and or xxxxxed unto my relation Edith Allen(?) the wife of Allen of Long Buckby in the County of Northampton Surgeon for and during the term of her natural life and I direct my said Trustees to pay the same free from the power xxxx or xxxxx of her husband and I direct that the xxxx about of the said Edith Allen notwithstanding her xxxxxxx shall be a good and sufficient xxxx to my said Trustees for such interest dividends and proceeds as aforesaid and upon trust in the next place within six calendar months as aforesaid to pay and apply the sum of five hundred pounds of the part of my said Trust monies unto my friend Charles Rattray of Daventry in the County of Northampton Doctor of Physics and to his executors axxxxs and assigns and upon Trust in the next place within six calendar months as aforesaid to put and place the sum of five hundred pounds xxxx part of my said Trust monies out at interest in their own names upon Government or good real security and pay and apply the half yearly Interest Dividends and proceeds from time to time as they shall xxxxx but(?) and payable unto or for the use benefit and advantage of my godson James Rattray one of the sons of my friend the said Charles Rattray for and during and until the said James Rattray shall attain the age of twenty one years and when at the period he shall attain that age I direct my said Trustees to pay over and apply the principal of the said sum of five hundred pounds unto the said James Rattray his executors axxxx and assigns and upon Trust within six calendar months as aforesaid to pay and apply the sum of five hundred pounds of the part of my said Trust monies unto and equally between Charles Freeman the said Richard Marriott Freeman Robert Freeman John Freeman Sarah King(?) and Mary Freeman sons and daughters of my Cousin Samuel Freeman late of Flore Fields in the said County of Northampton xxxxxxx as Tenants in Common and to their Executors axxxs and assigns upon trust within six calendar months as aforesaid to pay out and apply the sum of five hundred pounds the part of my said Trust monies unto and equally between William Freeman James Freeman Samuel Freeman Frances Emery(?) and Charlotte Watson sons and daughters of my cousin Simon Freeman late of Whilton in the said County of Northampton xxxxxxman as Tenants in Common and to their Executors axxxxs and assigns and after the several payments aforesaid I do hereby give and bequeath all and singular my household goods plate linen china books pictures xxxx woollen and articles of furniture horses cattle sheep and implements of husbandry and all my stock(?) and crop with the residue of my monies and securities for money and all the rest and remainder of my personal estate of every part and kind unto my Sister NEW PAGE Elizabeth Langton Bradshaw and with the payment of all my just debts my funeral expenses the charges of proving and carrying into execution the personal trusts of this my will and also subject and charge unto and with the payment of the several sums and legacies hereinafter mentioned that is to say To the said Ann King of Coventry widow the sum of two thousand pounds to whom I give and bequeath the same accordingly and to her executors xxxxx and assigns and I direct the same to be paid to her within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw and without interest in the meantime To the said Jane Freeman of Coventry aforesaid spinster the sum of two thousand pounds to whom I give and bequeath the same accordingly and to her executors xxxxx and assigns and I direct the same to be paid to her within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the meantime To the said Jane King of the Borough of Leicester widow the sum of two thousand pounds to whom I give and bequeath the same accordingly and to her executors xxxxx and assigns and I direct the same to be paid to her within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the meantime The sum of one thousand pounds unto the said Samuel Vanderplank and Richard Marriott Freeman and the survivor of them and the executors and xxxxxx of such survivors to who I give and bequeath the same to be paid within six calendar months after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the meantime and also upon this xxxxxal Trust and xxxxxx xxxxxx that is to say that they the said Samuel Vanderplank and Richard Marriott Freeman and the survivor of them and the Executors and xxxxx of such survivor do and shall upon receipt of the said sum of one thousand pounds put and place the same out at interest in their own name or the name of the survivor of them his Executors or axxxxs upon Government or good real security and pay and apply the half yearly interest dividends and proceeds thereof as they shall xxxxx but and be received unto or for the sole use benefit and advantage of the said Edith Allan wife of Allen of Long Buckby aforesaid Surgeon for and during the term of her natural life free from the power debts and control of her husband and from and immediately after the decease of the said Edith Allen I direct my said Trustees and the survivor of them and the Executors and axxxxs of such survivors to pay and apply the whole of the principal as well as the said sum of one thousands pounds now bequested as also the principal of the former(?) sum of five hundred pounds hereinbefore bequeathed unto and amongst all and every the child and children of the said Edith Allen by her present or any future husband she may hereafter marry in such parts shares and proportions and in such manner and form at their several and respective age and ages of twenty one years with Interest in the meantime from the death of the said Edith Allan their mother as she the said Edith Allan the mother shall by any deed or will or testament in writing to be executed by her in the presence of two or more witnesses notwithstanding her Cxxxxxre shall direct and appoint and in default of any such direction or appointment then upon Trust to pay and apply the whole of the principal of the said two several sums of one thousand pounds and five hundred pounds unto and equally between all and every the child and children of the said Edith Allan share and share alike as tenants in common at their several and respective ages of twenty one years as aforesaid with Interest for the same for the period of the death of their Mother as aforesaid and in case either(?) of the children of the said Edith Allan shall be under the age of twenty one years as aforesaid leaving lawful xxxxxx I direct the xxxxx of such of them as shall be so be paid the share the parent would have taken if living To the said Charles Rattray of Daventry aforesaid Doctor of Physics the sum of one thousand pounds to whom I give and bequeath the same accordingly and to his executors axxxxs and assigns and I direct the same to be paid to him within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the meantime the sum of five hundred pounds unto my Trustees the said Samuel Vanderplank and Richard Marriott Freeman and the survivor of them and the executors and axxxs of such survivor to whom I give and bequeath the same accordingly to be paid within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the Godson James Ratteay for and during and until he shall attain the age of twenty one years and when and as soon as he shall attain that age then I direct my said trustees to pay and apply the whole of the principal of the said sum of five hundred pounds bequeathed unto him the said James Rattery his Executors axxxxs and assigns To the said Charles Freeman Richard Marriott Freeman Robert Freeman John Freeman Sarah Knight(?) and Mary Freeman sons and daughters of my said cousin Samuel Freeman late of Flore Fields aforesaid Gentleman the sum of two thousand pounds to whom I give and bequeath them shall depart this life before his her or their share or shares of and in the said last mentioned sum of two thousand pounds shall xxxxx but and payable(?) having lawful issue then I direct the xxxx of each of them who shall so be as aforesaid to take and be paid the part or share their parent would have taken if living the same to be paid to such xxxx of their respective age and ages of twenty one years with interest from the period their parent or parents would have taken their part of share of and in the said sum of two thousand pounds if living To the said William Freeman James Freeman Samuel Freeman Florence Avery(?) and Charlotte Watson the sons and daughters of my cousin Simon Freeman late of Wilton aforesaid Gxxxxman the sum of two thousand pounds to whom I give and bequeath the same accordingly and to their executors axxxs and assigns as Tenants in Common and I direct the same be paid to them within six calendar months next after the decease of my sister the said Elizabeth Langton Bradshaw but without interest in the meantime and in case the said William Freeman James Freeman Samuel Freeman Florence Avery(?) and Charlotte Watson or either of them shall depart this life before his her or their share or shares of and in the said last mentioned sum of two thousand pounds shall xxxxxx but and payable leaving lawful xxxx then I direct the xxx of such of them who shall so be to take and be paid the share or part their parent would have taken if living the same to be paid to such xxxx at their age or ages of twenty one years with interest from the period the said sum of two thousand pounds is xxxxbfore directed to be paid and in case it shall happen that my said personal estate shall be found insufficient to answer the various legacies and payments I have hereby charged upon it then I do hereby in such case but not otherwise subject and change the same upon all and every my Real Estates as well those which I have now in possession accept(?) and I do hereby especially exempt my Mesuages Lands Tenements and xxxxits at Wilton as also those which I have contracted to purchase and may be possessed of and I do hereby under and by virtue of all powers and authorities in me vested or in any wise enabling me and for the purpose of devising the Real Estates over which I have or profess any disparing power or xxxx give and devise the same in manner following that is to say I give and devise all my Mesuage Tenement or Farm House with the yards gardens outbuildings and premises and also all and every my closes or enclosed grounds lands tenements and xxxxx whatsoever situate standing lying and being in the hamlet of Westhorp within the parish and precincts of Byfield in the County of Northampton together with the appurts(?) to the said xxxxxx and premises(?) belonging unto my said Trustees the said Samuel Vanderplank and Richard Marriott Freeman their heirs and assigns upon trust xxxxxx forthwith to sell and dispose the same by public auction or private xxxxx for such sum or sums of money as to them shall seem fit(?) and proper and I do hereby authorise and enpower my said Trustees or the survivors of them or the Exors or assigns of such Survivor to sign seal and deliver all such proper and monetary(?) deeds conveyances and assurances as may be fit and requisite for voting the said xxxxxx and premises and fee simple and xxxxxture thereof in the purchase or purchases or in such person or persons as txxxxxx or they shall direct and I do hereby direct my said Trustees or the survivor of them or the Executors or assigns of such survivor immediately after such sale and whom and as they shall shall receive the proceeds NEW PAGE money thereof to pay over the same unto my said sister Elizabeth Langton Bradshaw her executors axxxxs and assigns to whom I give and bequeath the same accordingly and I do hereby declare and direct that the receipt or receipts of my said Trustees or the survivor of them shall be good and sufficient discharge and xxxxxx to the purchaser or purchasers of the said estate and any part thereof for so much money as in such receipt or receipts shall be expected to be received and the said purchaser or purchasers shall not afterwards be answerable or accountable for the misapplication or nonapplication thereof and whereas I have by xxxxxx in writing bearing date the _______ day of ___ 1828 agreed with John xxxxxx Freeman for the sale to him in xxxxx of a xxxxxx Tenemant or xxxx with the outbuildings and several closes lands tenements(?) and xxxxxx with their appurts situate lying and being at Whilton in the County of Northampton at or for the price or sum of seventeen thousand five hundred pounds but which said Estate and Premises has not been conveyed or xxxx from me to the said John Stevens(?) Freeman Now I do hereby give and devise the said Mesuage Tenement or Farm House and the outbuildings and premises and also the several closes or enclosed grounds lands tenements(?) and xxxxx with this and every of their appurts situate lying and being within the parish precincts and xxxxxx of Wilton aforesaid unto the said said Samuel Vanderplank and Richard Marriott Freeman their heirs and assigns upon trust that they the said Trustees Samuel Vanderplank and Richard Marriott Freeman or the survivor of them or the executors or assigns of such survivor do and shall in all things and I do hereby authorise and enpower them completely to fulfil and carry into effect the stipulations and agreements in the said written contract mentioned and for the purpose to sign seal and deliver all such xxxxx deeds and other legal instruments as may be fit and proper for the purpose of xxxxing and xxxxing the said Estate and xxxxx at Whilton aforesaid and vesting the fee simple and inxxxxxxxx in the said purchase or in such person or persons as they shall direct and I do hereby also authorise and empower my said Trustees Samuel Vanderplank and Richard Marriott Freeman and the survivor of them and the Executors and assigns of such Survivor to receive from the said John Stevens(?) Freeman the purchase money for my said Real Estate at Whilton when and as the same shall xxxxxt but and payable under the terms of the said written contract But upon trust xxxxxx and for the particular purpose of paying and applying the same in aid(?) of the funds aforesaid for carrying into effect the general purposes of this my will and I do hereby declare and direct that the receipt or receipts of my said Trustees or the survivor of them shall be good and sufficient xxxxx and xxxxxxs for the said purcase money or for as much thereof as in such receipt or receipts shall be expected(?) to be received and paid John Stevens(?) Freeman his executors axxxxs or assigns shall not afterwards be answerable or accountable for the misappropriation or nonapplication of those funds and whereas I have also by Contract in writing bearing date of ____ day of _______ 1828 with a Mr.Teale and others for the purchase of certain lands tenements and xxxxxxx at Priors Marston at or for the price or sum of ______ _______ but with said lands tenements and xxxxx have not yet legally enpowered and xxxxx to me Now I do hereby request and also authorize and enpower my said Trustees to carry the said last mentioned Contract and agreement into complete execution and effect all intails and purposes whatsoever(?) and I do hereby also give and devise all that my Capital Freehold Mansion(?) with the yards gardens pleasure grounds hothouses greenhouses barns stables farm buildings and appurts also also the several closes or inclosed grounds of arable pasture and meadow land with the appurts to the said xxxxxx and premises belonging and also all these the lands tenements(?) and xxxx situate lying and being at Priors Marston aforesaid which I have contracted to purchase unto my sister the said Elizabeth Langton Bradshaw and her axxxxxs for and during the term of her natural life and from and immediately after her decease I give and devise the said Capital Mansion courtyards gardens pleasure grounds hothouses greenhouses barns stables farm buildings and appurts and also those closes or inclosed grounds of arable pasture and meadow land with the appurts and premises belonging and also all those the lands tenements and xxxxx situate at Priors Marston aforesaid which I have contracted to purchase unto my goddaughter Elizabeth Jane Vanderplank daughter of the said Samuel Vanderplank her heirs and assigns for ever in fee simple but in case it shall happen that the said Elizabeth Jane Vanderplank shall depart this life under the age of twenty one years without having lawful issue of her body her surviving or leaving such who shall be be under the age of twenty one years without lawful issue then and in such case I give and devise my said Freehold Capital Mansion with the yards hardens pleasure grounds hothouses greenhouses barns stables farm buildings and appurts and also all the several closes or inclosed grounds of arable pasture NEW PAGE or meadow lands with the appurts to the said xxxxx and premises belonging and also all those the lands tenements and xxxx at Priors Marston aforesaid which I have contracted to purchase unto my godson James Rattray son of my friend Charles Rattray of Daventry aforesaid and to his heirs and assigns forever in fee simple and all other the rest residue and remainder of my real and personal estate of what nature part or xxxxxever not hereinbefore disposed and subject and charged(?) as aforesaid I do hereby give and bequeath unto my said Sister Elizabeth Langton Bradshaw her heirs executors axxxxs and assigns forever and I do appoint her my residuary legatee and I do hereby declare that xxxxx it shall happen that my said Sister Elizabeth Langton Bradshaw shall depart this life before the whole of the purchase money of my said Wilton Estate shall become due and payable under the stipulations in the said written contract for the sale of the same and before the said purchase money shall be paid in pursuant(?) thereof and in case also my said personal estate shall be insufficient to pay and discharge the various legacies I have charged upon the same and which will by virtue of this my will become due and payable within six months next after my decease then and in such case I do hereby explicitly direct and declare that the payment of the said several legacies which I have xxxxxfore by this my will directed to be paid within six months from my said Sisters decease shall be postponed and deferred until the whole of the said purchase moneys for my said Wilton Estate shall have become due and payable under the terms and at the time specified in the said first xxxxx contract in writing and then I direct them to be paid in manner aforesaid but instead of within six months next after my said Sister Elizabeth Langton Bradshaw decease provided always and I do hereby declare and direct that it shall be lawful for my said Trustees and Trustee for the time being of this my will or of the said trust previous or any part thereof from time to time to xxxx and retain to and for himself and themselves respectively and also to allow and pay to his and their co trustees or trustee or to his or their Executors or axxxxs by or out of all or any of the said Trust Monies which by virtue thereof? or any of the trusts or powers therein maintained shall come to their respective hands all such fair and reasonable costs and expenses whatsoever which they or either of them shall pay bear or be put unto in or about the execution of the said Trusts or any of them or in the execution of this my will or in anywise relating thereto and further also that they and either of them my said Trustees or Trustee for the time being or their or either of their respective Executors or axxxxs shall be answerable or accountable for himself or themselves only and respectively and not the one for the other or others of them or for the acts or default of the other or others of them butcare(?) for himself only and for his own acts and default and that they or either of them shall be charged or chargeable with or for such sum of sums of money only as shall actually come to his or their own respective hands by virtue of any of the trusts aforesaid notwithstanding their or either of them joining in any receipt or other act for the sake of conformity(?) only for the the greater satisfaction only of the person or person paying the same and that they or any or either of them shall not be answerable for any loss that may happen in carrying out or investing all or any of the said Trust Monies or any part thereof under or in pursuant of the powers in this my will or liable for the insufficiency or deficiency of any Security whereso(?) the same may be placed or otherwise in the due execution of any of the trusts and powers herein contained save only for such loss as may happen by or through their of either of them wilful neglect and deafult and lastly I do hereby nominate constitute and appoint my said sister Elizabeth Langton Bradshaw sole exectutrix of this my last will and testament hereby revoking all former wills by me at any time heretofore made I do declare this alone to be my last will and testament in witness whereof I the said Testator Aholibab Bradshaw have to this my last Will and Testament contained in twenty one sheets of paper set my hand and seal this 26th day of May 1828 AHO BRADSHAW signed sealed published and declare by the above named Testator Aholiab Bradshaw and for this last will Will and Testament in our presence and attested subscribers in his presence first faithfully observed the alteration or addition which appears at the bottom of the and the third and at the top of the fourth sheet and also the xxxxxx in the fourth sheet to have been made previous to the execution thereof by the said Testator. PROVED at London 2nd August 1828 before the judge by the oath of Elizabeth Langton Bradshaw Spinster the sister the sole executrix to whom abxxxx was granted being first sworn (by xxxxx) duly to administer.


SMGP Notes;
The Rattray's were kin of the Freeman's/Langton's. Indeed the Manor of Whilton devolved to the Rev Langton Freeman (qv) who in turn left it to his nephew Thomas Freeman of Daventry, who's daughter inherited it and married Charles Rattray MD, his widow sold the Manor of Whilton.

We already knew that the Freeman's were relatives.
